If you worked at a Walmart retail store in Arizona as a nonexempt store employee at any point between April 10, 2020 and February 28, 2022, a class action lawsuit may affect your legal rights.
Walmart, Inc. and Wal-Mart Associates, Inc. (“Walmart”) have been sued for alleged violations of the Arizona Wage Act A.R.S. 23-350, et seq. related to Walmart’s pay and timekeeping practices surrounding its COVID Screening policies and practices. The Court has certified the case to proceed as a class action. A proposed settlement has been preliminarily approved by the Court. A notice was sent to Class Members, which explains the status of the case and Class Members’ rights in the settlement.

DO NOTHING ELSE | Stay in this lawsuit. Receive a settlement payment. Give up the right to sue. By doing nothing else, you will receive a check for your portion of the net settlement fund. But you give up any rights to sue Walmart separately about the same legal claims in this lawsuit. |
ASK TO BE EXCLUDED | Get out of this lawsuit. Get no benefits from it. Keep your right to sue Walmart separately. If you ask to be excluded before July 1, 2024, you won’t receive any money. But you keep any rights you otherwise have to sue Walmart separately about the same legal claims in this lawsuit. |
OBJECT | If you’re a Class Member, you can object to the settlement if you don’t like any part of it. You can give reasons why you think the Court should not approve it. If you properly present your objection, then the Court will consider your views. Any such objection must be filed by mailing the objection on or before July 1, 2024. |
